Terms of Service

1. Acceptance of Terms

By accessing or using propspedia.com ("Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users including buyers, sellers, builders, brokers, and visitors. If you do not agree to these Terms, you must not use the Platform. These Terms are governed by the laws of India, including the Indian Contract Act 1872, the Information Technology Act 2000, the Real Estate (Regulation and Development) Act 2016 (RERA), and applicable state regulations.

2. Nature of the Platform

Propspedia is an information aggregation and discovery platform — not a real estate broker, agent, or developer. Specifically: - Propspedia does not own, develop, construct or sell any property listed on the Platform. - Propspedia does not act as a representative or agent of any buyer, seller, builder or broker. - Propspedia facilitates the connection between buyers and property listing parties. All transactions occur directly between the buyer and the builder, developer, owner or broker. - Propspedia is not a party to any property purchase agreement, sale deed, builder-buyer agreement, or rental agreement. Propspedia's role is limited to: (a) presenting property information for search and discovery; (b) connecting buyers with listing parties via enquiry forms; and (c) verifying listed information against government RERA databases.

3. RERA Information — Important Disclaimer

Propspedia verifies RERA registration numbers against the respective state RERA authority's public database at the time of listing. However: 3.1 Verification limitations - RERA numbers are verified as of the date of listing. RERA registrations can lapse, be revoked, or be updated by the authority. Propspedia cannot guarantee real-time accuracy of RERA status. - Always verify the RERA number directly with the relevant authority before booking: - Tamil Nadu: tnrera.in - Karnataka: rera.karnataka.gov.in - Telangana: rera.telangana.gov.in - Kerala: K-RERA portal - Maharashtra: maharerait.maharashtra.gov.in 3.2 Buyer obligations under RERA Under Section 4(2)(l) of RERA, builders must publish project details on their respective state RERA website. Buyers have the right to inspect all project disclosures. Propspedia encourages buyers to review these disclosures independently. 3.3 No liability for RERA status changes Propspedia shall not be liable for any loss arising from a change in RERA registration status that occurred after a listing was published on the Platform.

4. Pricing Information Disclaimer

All prices displayed on Propspedia are indicative and subject to change without notice. - Prices are provided by builders, developers, owners or brokers and represent prices at the time of listing. - Final pricing is determined by the builder or property owner in the sale or rental agreement. - Prices do not include stamp duty, registration charges, GST (on under-construction properties), society maintenance deposits, or any other applicable charges. - For under-construction properties, prices may change based on construction progress, area adjustments, or escalation clauses in the builder-buyer agreement. - Propspedia is not responsible for any discrepancy between prices shown on the Platform and prices quoted by the builder, owner or broker. Always confirm the final price, included charges, and payment schedule directly with the builder or listing party before executing any agreement.

5. Zero Buyer Brokerage Policy

Propspedia operates a zero buyer brokerage model. This means: - Buyers are never charged any brokerage, referral fee, or platform fee by Propspedia for accessing listings or submitting enquiries. - Builders and brokers who list properties on Propspedia pay a listing or lead fee to Propspedia — not the buyer. Important caveat: If a listing is marked as a "Broker Listing," the broker associated with that listing may charge brokerage as part of the property transaction, consistent with market practice and any agreement between the buyer and broker. Propspedia's zero-brokerage commitment applies to Propspedia's fees, not to any separate agreements you enter with brokers or builders.

6. User Conduct

You agree not to: - Submit false, misleading or fraudulent property listings or enquiries - Use automated bots, scrapers or crawlers to extract listing data without written permission - Attempt to reverse-engineer, disassemble or copy any proprietary feature of the Platform - Use the Platform to harass, spam or solicit other users outside of a legitimate property enquiry - List properties for which you do not have legal authority to list (ownership, power of attorney, or broker mandate) - Publish content that violates RERA regulations, including unlicensed brokerage advertisements or pre-launch marketing of unregistered projects Violation of these rules may result in account suspension and, where applicable, reporting to relevant authorities.

7. Intellectual Property

The Propspedia brand, logo, PropScore™ methodology, and Platform design are owned by Propspedia and protected under Indian intellectual property law. Property listing content (descriptions, images, floor plans) provided by builders, owners or brokers remains the intellectual property of the respective listing party. By submitting content to Propspedia, listing parties grant Propspedia a non-exclusive, royalty-free licence to display that content on the Platform and in related marketing for the duration of the listing. You may not reproduce, republish or commercially use any Platform content without prior written consent from Propspedia.

8. Limitation of Liability

To the maximum extent permitted by applicable law: - Propspedia provides the Platform on an "as is" and "as available" basis without warranties of any kind. - Propspedia is not liable for any direct, indirect, incidental, special or consequential damages arising from your use of the Platform, including but not limited to: property transaction losses, reliance on inaccurate listing information, builder default or project delays. - Propspedia's total liability in connection with any claim shall not exceed the amount paid by you to Propspedia in the 12 months preceding the claim. For free-tier users, this limit is ₹1,000. - Nothing in these Terms excludes liability for death or personal injury caused by Propspedia's negligence, or for fraud or wilful misconduct.

9. Dispute Resolution

9.1 Consumer disputes regarding property transactions Disputes between buyers and builders regarding property transactions, RERA registration, possession delays, or construction quality should be filed with the relevant state RERA authority. Propspedia can assist in identifying the appropriate RERA forum but is not party to such disputes. 9.2 Disputes with Propspedia Any dispute arising from these Terms or your use of the Platform shall be first subject to good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act 1996, with a sole arbitrator appointed by mutual consent. The seat of arbitration shall be Chennai, Tamil Nadu. 9.3 Governing law These Terms are governed by Indian law. Subject to the arbitration clause above, Chennai courts shall have jurisdiction.

10. Account Termination

You may close your Propspedia account at any time by emailing support@propspedia.com. Propspedia may suspend or terminate your account if: (a) you breach these Terms; (b) we receive a court or regulatory order; (c) your account is associated with fraudulent activity. On termination, your access to the Platform ceases, but these Terms continue to apply to any obligations that arose prior to termination.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via a notice on propspedia.com at least 15 days before they take effect. Continued use of the Platform after the effective date of updated Terms constitutes acceptance.
